Danish landlord repair-claim deadline after move-out

A restoration claim under § 187(1) generally cannot be made after more than two weeks. For a landlord with an inspection duty, the period runs from the move-out inspection. For a tenancy outside that duty, it runs from the move-out date.

First determine whether the landlord had the inspection duty. Day 0 is the inspection when that duty applies; otherwise it is the move-out day. The ordinary restoration claim must generally be raised by Day 14. A first claim on Day 15 appears late, subject to the hidden-defect and fraud exception and separate deposit items.

    Last ordinary day to raise the restoration claim

    The issue is when a sufficiently identified claim was communicated, not necessarily when the final invoice arrived.

    A first ordinary restoration claim appears late

    Hidden defects, fraud allegations and non-restoration deposit items require separate assessment.

Choose the correct starting point

Do not count automatically from key return, invoice date or deposit statement. First determine whether § 187(3) required the landlord to hold a move-out inspection. That determines whether the starting point is the inspection or the move-out day.

Check the contents as well as the date

Where a move-out report was required, § 187(2) also addresses restoration items left out of that report. Record every claimed item and compare it with the report instead of looking only at the total amount.

Important exception

The statutory deadline and report limitation do not apply in the same way to a defect that could not be discovered with ordinary care or where the tenant acted fraudulently. Such allegations require evidence and cannot be resolved by dates alone.
